1. Acceptance of terms:
 

By participating in any of our events, including but not limited to lessons, drills, or events, you accept these Terms of Service, which may be updated by us from time to time without notice to you. In addition, when using particular TennisLink owned or operated services, you and TennisLink shall be subject to any posted guidelines or rules applicable to such services, which may be posted from time to time. All such guidelines or rules are hereby incorporated by reference into these TOS. TennisLink may also offer other services that are governed by different Terms of Service.

2. Specific service items:

Web site & PayPal signups: We appreciate your business and our web site purchases are normally carried out through PayPal, which may post its own Terms of Service. TennisLink may request additional confirmations and information before being able to accept your payments as a purchase order.

MakeUp Policy: If your schedule is by contract, meaning all or most of your package is scheduled in advance; or if you have a “will call” package, TennisLink has a flexible and fair makeup policy. If a session is canceled by TennisLink due to weather, you can count on a call or e-mail from TennisLink to cancel and at that time a make up is awarded and can be scheduled. If not scheduled at that time you have one week to call TennisLink to schedule your makeup. All makeups must be scheduled within a calendar week of the cancelled session. MakeUps are awarded to persons who give 48 hours notice before missing a session, provided the session is made up within a calendar week of the missed session. MakeUps are not awarded for no-shows. No Make-Ups on Yearly Packages or Facility Sponsor Packages.

Gift Certificates: These are sold to the buyer. The buyer, regardless of who the recipient is, agrees to accept receipt of the certificate at time of payment in a reply e-mail at time of notification of payment received for said certificate, thereby authenticating the PayPal transaction as delivered. Buyer also agrees that there are NO REFUNDS or EXCHANGES in gift certificate transactions and that the certificate must be redeemed within 90 days of delivery by e-mail or otherwise and that all services due as a result of a gift certificate must be completed within 1 year of that date if a yearly certificate is delivered or as per terms and conditions contained below in Package Duration with respect to the other certificates. Furthermore, it is understood by the buyer that the buyer is buying a certificate or when not immediately delivered, the promise to deliver a certificate not the service attached when the recipient renders said certificate.

Package Duration and Expiration : All packages are written to enable the client to achieve the best possible results in term of progress in their game. Strict dedication to the term of a package is a very important point within the scope of overall progress. It is important to note that packages expire after a certain time!

Example: A player who is taking a 12 hour package is committed to a once a week schedule for 3 months. If that player can then only commit to play once every other week, they will leave 6 unfinished sessions within that commitment period. That person's progress will suffer and we will not offer extensions or refunds. TennisLink expects all packages to be completed within the following timetable, with due respect to the above mentioned MakeUp Policy:

TennisLink Packages and gift certificates are NON-Transferable.

Tennis Ladder: What we are providing is access to a list of players and therefore, once membership is approved, there will be no refunds. Non-TennisLink related e-mails and other abuse of the e-mail system will lead to removal from the Ladder with no refund. Two No-Shows will also lead to removal from the Ladder with no refunds.

Pre Owned Equipment: TennisLink might offer Pre Owned Equipment as a service to its members, package holders, virtual members (Yahoo Group) and the tennis public. We strive to ensure quality, but equipment is sold as is. Buyer agrees that TennisLink will accept no responsibility for or be charged with any responsibility for any injuries connected with the purchase of any equipment from this site or from TennisLink staff.

All Sales Of Used Equipment Are Final

3. Registration Obligations

TennisLink.org Yahoo Group Membership is FREE! It is also essential as a means of receiving information from us about events or their cancellation or rescheduling. As a TennisLink Yahoo Member you will however not receive an ID-Pass to the Member Pages. These are reserved for Ladder players, or other events participants.

As you use of our services, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the contact form and (b) maintain and promptly update the data in the contact form to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or TennisLink has reasonable grounds to suspect same such, we reserve the right to suspend or terminate your membership and refuse any and all current or future uses of our services.

As you register through the Contact form and subscribe to the Yahoo mailing group, we will reasonably endeavor to protect your privacy. However, TennisLink cannot be held liable for for malicious exploits of our web site or other forms of unlawful access to information. You understand that through your use of our services, you consent to the collection, storage, and use of your information. TennisLink might also be forced by law to divulge information.

Information in the Member Pages is protected through a password gate. You are responsible for maintaining the confidentiality of the password and are fully responsible for all activities that occur under your password. You agree to (a) immediately notify TennisLink of any unauthorized use of your password or any other breach of security, and (b) ensure that you exit from your account at the end of each session. TennisLink cannot and will not be liable for any loss or damage arising from your failure to comply with these rules.

Use of our services, the web site, and the Yahoo Mailing Group

You agree not to: 

1. upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
    
2. harm minors in any way;
    
3. impersonate any person or entity, including, but not limited to a TennisLink staff member or volunteer or otherwise misrepresent your affiliation with a person or entity;
    
4. forge headers or otherwise manipulate identifiers in order to disguise the origin of any content;
    
5. upload, post, email, transmit or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
    
6. upload, post, email, transmit or otherwise make available any content that infringes on any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
    
7. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
    
8. upload, post, email, transmit or otherwise make available any material that contains software viruses, malware, adware, or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
    
9. collect or store personal data about other users in connection with the prohibited conduct and activities mentioned in these terms of service.
   

Use of photos and names: We will at times publish photos and names of members in relation to events that have taken place. You will not hold TennisLink liable for such use. If you want TennisLink to remove mention of your name or photos, or any other information that is related to you, please inform us via e-mail.

4. Waiver of Liability:

By participating in our activities, you agree to the following Assumption of Risk, and Indemnity Agreement for Tennis Activities

"In consideration of being given the opportunity to participate in tennis activities sponsored by TennisLink, a sole proprietorship in Virginia, I HEREBY ACKNOWLEDGE, AGREE AND REPRESENT on my own behalf and for my personal representatives, assigns, heirs, and next of kin, as follows: I UNDERSTAND THE NATURE OF TENNIS AND TRAINING FOR TENNIS (“TENNIS ACTIVITIES”) both on tennis courts and at other training sites wherever located, and represent that I AM QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH TENNIS ACTIVITIES.

1. I FULLY UNDERSTAND THAT TENNIS ACTIVITIES CAN INVOLVE RISKS AND DANGERS of bodily injury, including permanent disability, paralysis and even death (“Risks and Dangers”); that these Risks and Dangers may be caused by my own actions, or inactions, the actions or inactions of others participating in the Tennis Activities, the conditions under which the Tennis Activities take place, and of the potential of negligence of all those involved; that there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation in Tennis Activities.

2. I AGREE AND WARRANT that I will examine and evaluate each Tennis Activity in which I participate that is sponsored by TennisLink, and that, if I observe any condition which I consider to be unacceptably hazardous or dangerous to me, I will notify the proper authority in charge of the Tennis Activity and will refuse to take part in the Activity until the condition has been corrected to my satisfaction.

3. I HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE TennisLink, its administrators, directors, agents, officers, volunteers and employees, other participating organizers, any sponsors, advertisers, facilities and clubs where TennisLink Activities are held, facility sponsors and, if applicable, owners and lessors of the premises on which the Tennis Activities take place ("Tennis Releasees"), and I assume all risks and hold Tennis Releasees harmless from all liability, claims, demands, losses or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Tennis Releasees, or otherwise, including negligent attempts to treat any injuries resulting from Tennis Activities; and, I further agree that if, despite this release and waiver of liability, my assumption of risk, and my indemnity agreement, I, or anyone on my behalf, makes a claim against any of the Tennis Releasees, I WILL INDEMNIFY, SAVE AND HOLD HARMLESS each of the Tennis Releasees, from any litigation expenses, attorney fees, loss, liability, damage, or costs which I may incur as a result of such claim.

By participating in TennisLink activities, I declare that I have understood this agreement, fully understand its terms, and understand that I have given up rights and intend to completely and unconditionally release all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.

PARENTAL CONSENT

(Participants Under 18 Years of Age)

I, the parent and/or legal guardian of a minor participating in Tennis Activities sponsored by TennisLink, have read the Waiver of Liability, Assumption of Risk, and Indemnity Agreement for Tennis Activities for the minor, and represent that I understand the nature of Tennis Activities and the minor’s experience and capabilities and believe the minor to be qualified to participate in such Tennis Activities. I hereby release, discharge, covenant not to sue, and AGREE TO INDEMNIFY, SAVE, AND HOLD HARMLESS each of the Tennis Releasees from all liability, claims, demands, losses, or damages on the minor’s account caused or alleged to be caused in whole or part by the Tennis Activities sponsored by TennisLink, and further agree that if despite this release, I, the minor, or anyone on the minor’s behalf makes a claim against any of the above Tennis Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS each of the Tennis Releasees from any litigation expenses, attorney fees, loss liability, damage, or cost any may incur as the result of any such claim.
